Streamcentives DMCA & Copyright Policy

1. Introduction

Streamcentives, Inc. ("Streamcentives," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement that are reported to our designated Copyright Agent.

2. Filing a DMCA Takedown Notice

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on the Streamcentives platform, please notify our Copyright Agent with a written notice containing the following information:

Required Information

  1. Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest that is allegedly infringed.
  2. Identification of Copyrighted Work: Identification of the copyrighted work(s) claimed to have been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list of such works.
  3. Identification of Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed, and information reasonably sufficient to permit us to locate the material (e.g., direct URL links to the content).
  4. Contact Information: Your address, telephone number, and email address.
  5. Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed.

3. Designated Copyright Agent

Note: Only DMCA notices should be sent to the Copyright Agent. Other inquiries should be directed to support@streamcentives.io.

4. Counter-Notification Procedure

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with us. A counter-notification must include the following:

  1. Physical or Electronic Signature: Your physical or electronic signature.
  2. Identification of Removed Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.
  3. Good Faith Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Northern District of California if you reside outside the United States), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  5. Contact Information: Your name, address, telephone number, and email address.

Upon receipt of a valid counter-notification, we will provide a copy to the original complaining party. If we do not receive notice within 10-14 business days that the original complaining party is seeking a court order to prevent further infringement, we may restore the removed material.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Streamcentives has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers.

What Constitutes a Repeat Infringer

  • Users who have had content removed due to valid DMCA notices on multiple occasions
  • Users who repeatedly post infringing content after warnings
  • Users who show a pattern of copyright infringement

Consequences

  • First Violation: Content removal and warning
  • Second Violation: Content removal, warning, and temporary feature restrictions
  • Third Violation: Account suspension or permanent termination

We reserve the right to terminate accounts after fewer violations in cases of egregious or willful infringement.

6. Content Removal Process

6.1 Upon Receipt of Valid Notice

  1. We will remove or disable access to the allegedly infringing material promptly
  2. We will notify the user who posted the content of the takedown
  3. We will provide information about how to file a counter-notification

6.2 Timeframes

  • Takedown: We aim to process valid DMCA notices within 24-48 hours
  • Counter-Notification Review: 10-14 business days for potential restoration
  • Restoration: If no lawsuit notice is received, content may be restored after waiting period
